Consent and Communications Policy

This Consent and Communications Policy explains how More Than Heart – Family & Caregiver Training, also referred to as “More Than Heart,” “we,” “our,” or “us,” requests, records, uses, and honors consent relating to electronic communications, mobile messages, telephone calls, marketing, electronic records, automatic-renewal memberships, recordings, testimonials, and voluntarily submitted information.

This policy applies to interactions with More Than Heart through:

  • https://morethanheart.com;
  • The Vault membership;
  • Website forms;
  • Email;
  • SMS and MMS text messages;
  • Telephone calls;
  • Webinars;
  • Podcasts;
  • Virtual and in-person events;
  • Educational programs;
  • Social-media platforms;
  • Customer-support communications; and
  • Other services that link to this policy.

This policy should be read together with our:

  • Website Terms of Service;
  • Privacy Policy;
  • Automatic Renewal and Membership Terms; and
  • Any additional consent language presented when you register, purchase, subscribe, submit information, or participate in a program.

1. General Consent Principles

More Than Heart seeks consent in a manner that is clear, specific, and appropriate for the communication, transaction, or activity involved.

Your consent may be requested through:

  • An unchecked checkbox;
  • An electronic signature;
  • A website form;
  • An account setting;
  • A written agreement;
  • A recorded verbal agreement;
  • A text-message response;
  • An email response; or
  • Another method permitted by applicable law.

Consent to one activity does not automatically constitute consent to every other activity.

For example:

  • Consent to receive an event reminder does not automatically constitute consent to receive promotional text messages;
  • Consent to receive email newsletters does not automatically constitute consent to receive marketing text messages;
  • Providing a telephone number for customer service does not automatically constitute consent to receive recurring automated marketing calls;
  • Creating an account does not automatically enroll you in a recurring membership; and
  • Agreeing to the Website Terms does not, by itself, authorize an automatic-renewal charge.

Where separate consent is legally required or appropriate, More Than Heart will request that consent separately.

2. Acknowledgment of Website Policies

By accessing or using the Website, you acknowledge that you have been provided access to the Website Terms of Service and Privacy Policy.

Your use of the Website does not, by itself, mean that you:

  • Consent to receive promotional text messages;
  • Consent to receive automated marketing calls;
  • Subscribe to marketing emails;
  • Agree to an automatically renewing membership;
  • Authorize the public use of your name, image, voice, or testimonial; or
  • Consent to the sale of your personal information.

Those permissions will be requested separately where applicable.

3. Electronic Records and Signatures

More Than Heart may provide agreements, notices, confirmations, disclosures, receipts, renewal notices, cancellation confirmations, and other records electronically.

By completing an electronic transaction, selecting an agreement checkbox, typing your name, submitting an electronic signature, or otherwise indicating agreement electronically, you agree that your electronic action may serve as your signature and evidence of your intent to agree.

Electronic records may be delivered through:

  • Email;
  • Your online account;
  • A downloadable document;
  • A website confirmation page;
  • A text message containing a link;
  • A customer portal; or
  • Another electronic method disclosed to you.

You should retain copies of important electronic records for your files.

3.1 Technical Requirements

To receive and retain electronic records, you should have:

  • Internet access;
  • A valid email address;
  • A device capable of displaying web pages and electronic documents;
  • Current web-browser software; and
  • The ability to download, save, or print electronic records.

3.2 Paper Copies

You may request a paper copy of an electronic record by contacting:

We will inform you before fulfilling the request if a reasonable printing or mailing fee applies.

3.3 Updating Your Information

You are responsible for maintaining a current email address, telephone number, billing address, and other contact information.

You may update your information through your account or by contacting More Than Heart.

3.4 Withdrawing Electronic-Records Consent

Where applicable, you may withdraw consent to receive legally required records electronically by contacting us.

Withdrawal will apply prospectively and will not affect the validity of electronic records, signatures, notices, or transactions completed before the withdrawal.

If electronic delivery is reasonably necessary to provide an online-only product or membership, withdrawing consent may affect our ability to continue providing that service. We will disclose any such consequence before processing the withdrawal.

4. Service and Transactional Communications

When you create an account, register for an event, purchase a product, enroll in a program, submit a support request, or become a member, More Than Heart may send non-promotional communications reasonably necessary to provide the requested service.

These may include:

  • Account confirmations;
  • Password-reset messages;
  • Purchase receipts;
  • Billing notices;
  • Security alerts;
  • Membership notifications;
  • Renewal notices;
  • Cancellation confirmations;
  • Webinar access information;
  • Event reminders;
  • Scheduling communications;
  • Changes affecting a purchased service;
  • Responses to customer-support requests; and
  • Legally required notices.

These communications are different from marketing communications.

You may not be able to opt out of communications that are reasonably necessary to administer an active account, transaction, membership, registration, or legal obligation.

5. Email Marketing Consent

You may voluntarily subscribe to receive promotional emails from More Than Heart.

Marketing emails may include:

  • Caregiver education;
  • Aging-related information;
  • Newsletters;
  • New educational resources;
  • Program announcements;
  • Webinar and event promotions;
  • The Vault membership information;
  • Product announcements;
  • Special offers; and
  • Other More Than Heart news.

Where an email subscription option is provided, the consent box should not be preselected.

You may unsubscribe at any time by:

  • Selecting the unsubscribe link in a marketing email; or
  • Contacting inquiries@morethanheart.com.

After unsubscribing, you may continue to receive transactional or service-related messages concerning an account, purchase, registration, membership, security matter, or customer-support request.

More Than Heart will not use false sender information or deceptive subject lines in commercial email communications. Marketing emails will identify More Than Heart and include a valid mailing address and a reasonably accessible unsubscribe method.

6. Mobile Text-Message Consent

6.1 Voluntary Mobile Consent

Where a mobile messaging option is offered, you may separately consent to receive SMS or MMS text messages from More Than Heart at the mobile number you provide.

Consent to receive marketing text messages is voluntary and is not a condition of:

  • Purchasing a product;
  • Creating an account;
  • Registering for an event;
  • Enrolling in a membership;
  • Receiving caregiver education; or
  • Using the Website.

More Than Heart may offer separate choices for informational and marketing text messages.

6.2 Informational Text Messages

Informational messages may include:

  • Registration confirmations;
  • Webinar reminders;
  • Event reminders;
  • Scheduling information;
  • Customer-service responses;
  • Account notifications;
  • Membership-related notifications;
  • Requested caregiver resources;
  • Educational alerts; and
  • Security or service notices.

6.3 Marketing Text Messages

Marketing messages may include:

  • Program announcements;
  • New membership information;
  • Webinar and event promotions;
  • Product announcements;
  • Educational offers;
  • Newsletter notifications;
  • Special promotions; and
  • Other marketing messages from More Than Heart.

6.4 Automated Technology

By expressly opting into a mobile messaging program, you authorize More Than Heart and service providers acting on its behalf to send recurring messages to the mobile number you provide.

Messages may be sent using automated dialing or messaging technology where permitted by law.

Your consent applies to More Than Heart and vendors sending communications on More Than Heart’s behalf. It does not authorize unrelated companies to use your number for their own independent marketing.

6.5 Message Frequency and Charges

Message frequency varies according to:

  • The programs you select;
  • Your account activity;
  • Events for which you register;
  • Resources you request;
  • Membership activity; and
  • Your communication preferences.

Message and data rates may apply under your mobile carrier’s service plan.

More Than Heart does not control carrier charges and is not responsible for delayed or undelivered messages.

6.6 Withdrawing Mobile Consent

You may withdraw consent to receive text messages at any time by:

  • Replying STOP;
  • Using another recognized opt-out keyword;
  • Clearly replying that you want the messages to stop;
  • Contacting More Than Heart by telephone;
  • Sending an email to inquiries@morethanheart.com; or
  • Using another reasonable method that clearly communicates your request.

More Than Heart will honor reasonable revocation requests within the period required by applicable law.

We may send one final non-promotional message confirming that your opt-out request has been processed.

Where supported, you may reply HELP for assistance.

Opting out of text messages does not automatically unsubscribe you from email communications. Email preferences must be managed separately.

6.7 Responsibility for the Mobile Number

By providing a mobile number, you represent that:

  • You are the subscriber or customary user of the number;
  • You are authorized to provide consent for that number;
  • The number is accurate; and
  • You will notify us if the number is changed, reassigned, or no longer under your control.

You may not provide another person’s mobile number without that person’s permission.

6.8 No Emergency or Confidential Texting

Text messages should not be used for:

  • Medical emergencies;
  • Urgent health concerns;
  • Crisis communications;
  • Complete medical records;
  • Social Security numbers;
  • Insurance identification numbers;
  • Complete payment-card information; or
  • Other highly sensitive information.

Text messages may not be encrypted or delivered immediately.

In an emergency, call 911 or the appropriate emergency-service provider.

7. Telephone-Call Consent

When you provide a telephone number, More Than Heart may use it to:

  • Return a call you requested;
  • Respond to an inquiry;
  • Provide customer support;
  • Discuss an account, registration, purchase, or membership;
  • Confirm or reschedule an appointment;
  • Address a billing or cancellation request; or
  • Provide another communication reasonably related to your request.

Separate consent may be requested before using automated or prerecorded technology for promotional calls.

You may revoke consent to receive promotional calls by clearly communicating that you no longer wish to receive them.

A request to stop marketing calls will not prevent More Than Heart from contacting you when reasonably necessary to respond to a new request, address an account or transaction, provide a legally required notice, or handle an emergency or safety concern.

8. Automatic-Renewal Membership Consent

Enrollment in The Vault or another automatically renewing program requires consent separate from general Website use.

Before completing an automatic-renewal purchase, More Than Heart will clearly disclose:

  • The membership or service being purchased;
  • The price;
  • The billing frequency;
  • The length of the renewal period;
  • That the membership continues until canceled;
  • How to cancel;
  • Any trial or promotional terms;
  • The amount charged after a trial or promotion; and
  • Other material renewal conditions.

The customer must affirmatively agree to the automatic-renewal terms before being charged.

More Than Heart will provide a confirmation that the customer can retain. The confirmation will include the renewal terms, cancellation policy, and instructions for canceling.

Automatic-renewal consent will not be:

  • Hidden inside general Website Terms;
  • Inferred from silence;
  • Obtained through a preselected checkbox;
  • Combined with marketing-text consent;
  • Combined with email-marketing consent; or
  • Contradicted by other information displayed during checkout.

Cancellation and renewal procedures are governed by the Automatic Renewal and Membership Terms presented at enrollment.

9. Cookies and Tracking Choices

The Website may use cookies, analytics tools, pixels, tags, and similar technologies as described in the Privacy Policy.

Where required or made available, you may manage optional technologies through the Website’s cookie-preference tool.

Cookie categories may include:

  • Strictly necessary cookies;
  • Functional cookies;
  • Analytics cookies;
  • Advertising cookies; and
  • Social-media technologies.

Rejecting optional cookies does not prevent the use of technologies that are reasonably necessary to:

  • Operate the Website;
  • Maintain security;
  • Process a transaction;
  • Remember privacy preferences;
  • Authenticate an account; or
  • Provide a service requested by the visitor.

Where required by applicable law, More Than Heart will recognize qualifying browser-based privacy preference signals.

10. Voluntary Submission of Caregiving and Health Information

You may voluntarily provide information about an aging adult, caregiver, family situation, health concern, housing need, or related circumstance when requesting educational information or assistance.

By submitting that information, you authorize More Than Heart to use it for the limited purpose of:

  • Responding to your request;
  • Providing requested educational resources;
  • Delivering a program or service;
  • Managing your account;
  • Providing customer support;
  • Protecting an individual’s safety; or
  • Complying with applicable law.

Do not submit information about another person unless:

  • You have that person’s permission;
  • You are legally authorized to act for that person; or
  • The disclosure is otherwise permitted by law.

More Than Heart is an educational caregiver-training organization and does not operate the Website as a medical provider, medical-record system, or secure patient portal.

Submitting health-related information does not create a physician-patient or other healthcare-provider relationship.

11. Webinar, Event, and Meeting Recordings

More Than Heart may record certain webinars, virtual meetings, interviews, educational sessions, podcasts, or events.

When a session will be recorded, More Than Heart will provide reasonable notice through:

  • The registration page;
  • The event description;
  • An email;
  • An on-screen notice;
  • A verbal announcement;
  • Signage at an in-person event; or
  • Another appropriate method.

By knowingly remaining in and participating in a recorded session after receiving notice, you consent to the recording of your participation to the extent permitted by law.

However, separate permission may be requested before using an identifiable participant’s:

  • Name;
  • Image;
  • Voice;
  • Personal story;
  • Question;
  • Testimonial; or
  • Likeness

in public advertising, promotional materials, social-media content, or commercial campaigns.

Participants who do not wish to appear in a recording should follow the participation instructions provided for the event, which may include disabling their camera, muting their microphone, using the chat privately, or contacting the organizer before participating.

12. Testimonials, Stories, Images, and Media Releases

More Than Heart will seek appropriate authorization before publicly using an identifiable person’s testimonial, photograph, video, voice, personal story, or likeness for marketing or promotional purposes.

A media or testimonial release may explain:

  • What material may be used;
  • Where it may appear;
  • Whether the person’s name may be used;
  • Whether editing is permitted;
  • Whether compensation is provided;
  • How long the authorization applies; and
  • Whether the authorization may be withdrawn.

Withdrawal of a media authorization will generally apply prospectively.

More Than Heart may not be able to remove materials that were already:

  • Printed;
  • Published;
  • Distributed;
  • Incorporated into completed productions;
  • Shared by third parties; or
  • Legally retained before the withdrawal.

13. Surveys, Reviews, and Feedback

When you voluntarily submit feedback, a review, survey response, or suggestion, you consent to our use of that information to:

  • Improve the Services;
  • Evaluate programs;
  • Train team members;
  • Address concerns;
  • Develop educational materials; and
  • Operate the business.

We will request additional permission before using an identifiable review or personal story as a public testimonial when such permission is required.

14. Consent Records

More Than Heart may retain records showing:

  • The language presented when consent was requested;
  • The date and time of consent;
  • The website page or form used;
  • The telephone number or email address provided;
  • The consent option selected;
  • The IP address or device information associated with an online submission;
  • The membership terms accepted;
  • The version of the applicable policy;
  • Communications sent;
  • Opt-out requests;
  • Cancellation requests; and
  • Confirmation that a request was processed.

These records may be used to:

  • Honor communication preferences;
  • Administer memberships;
  • Demonstrate compliance;
  • Resolve disputes;
  • Prevent unauthorized activity; and
  • Meet legal or contractual requirements.

Automatic-renewal consent records will be retained for at least the period required by applicable law.

15. Withdrawing Consent

Unless a specific law or agreement provides otherwise, you may withdraw consent prospectively by contacting More Than Heart.

Withdrawing consent does not:

  • Invalidate actions lawfully taken before withdrawal;
  • Reverse a completed purchase;
  • Automatically create a right to a refund;
  • Cancel an automatic-renewal membership unless you follow an authorized cancellation method;
  • Delete information that must be retained by law;
  • Prevent necessary transactional communications; or
  • Require removal of material already lawfully published or distributed.

Different types of consent must be managed separately.

For example:

  • Text-message consent may be withdrawn by replying STOP or making another reasonable request;
  • Email-marketing consent may be withdrawn through the unsubscribe link;
  • Automatic renewal must be canceled through the cancellation process;
  • Cookie preferences may be changed through the cookie tool or browser;
  • Media permission may be withdrawn using the contact method stated in the applicable release; and
  • Electronic-record consent may be withdrawn by contacting us.

16. Service Providers

More Than Heart may use service providers to operate:

  • Website forms;
  • Email delivery;
  • Text messaging;
  • Telephone communications;
  • Membership accounts;
  • Payment processing;
  • Scheduling;
  • Customer-relationship management;
  • Webinar hosting;
  • Data storage;
  • Analytics; and
  • Consent-record management.

Providing consent to More Than Heart authorizes these vendors to process information only as reasonably necessary to provide services on More Than Heart’s behalf or as otherwise permitted by law.

Mobile numbers, mobile opt-in information, and SMS consent records will not be sold or provided to unrelated third parties for their own independent marketing purposes.

17. No Sale of Consent

More Than Heart does not sell a person’s consent.

Consent given to More Than Heart does not authorize an unrelated business to contact you for its independent marketing purposes.

If More Than Heart offers a program jointly with another organization and both organizations wish to contact participants, the identity of each organization and the applicable communication permissions should be clearly disclosed when consent is requested.

18. Children and Consent Authority

The Services are intended for adults.

You must be at least 18 years old to:

  • Create a membership account;
  • Make a purchase;
  • Agree to automatic renewal;
  • Provide marketing consent; or
  • Enter into another binding agreement through the Website.

By submitting information about another person, you represent that you have appropriate permission or legal authority to do so.

19. Changes to This Policy

More Than Heart may update this Consent and Communications Policy to reflect:

  • Changes to the Services;
  • New communication methods;
  • Changes in technology;
  • Updated consent practices; or
  • Legal and regulatory developments.

The “Last Updated” date will be revised when changes are made.

Material changes may also be communicated by:

  • Website notice;
  • Email;
  • Account notification;
  • Text message;
  • A new consent request; or
  • Another reasonable method.

A policy update will not replace a new consent when applicable law requires More Than Heart to obtain separate or renewed consent.

20. Relationship to Other Policies

This Consent and Communications Policy supplements the Website Terms of Service, Privacy Policy, and Automatic Renewal and Membership Terms.

If the documents address different subjects, each will apply to its respective subject.

If there is a conflict:

  • The specific consent language presented at the time of a transaction will control for that transaction;
  • The Automatic Renewal and Membership Terms will control recurring billing and cancellation;
  • The Privacy Policy will control the collection, use, disclosure, and retention of personal information; and
  • The Website Terms of Service will control general use of the Website and Services.

Nothing in these policies limits rights that cannot legally be waived.
